The next door neighbours have erected fences on both our side and the other next door, ie both sides of their yard, the fences have been placed on top of an existing 4ft wall making the overall height about7ft from ground level. They have not asked either side if we in fact mind them doing this, the frame of the fence is on our side of the yard with nails sticking through the wood and exposed on our side, its a totally solid fence in raw wood, looking shoddy and taking light from our yard. Is this legal and how could I approach the problem without causing a fall out, these neighbours have already had major disagreements with other neighbours. the only thing Ive had with them was a little strange they asked me to stop the birds flying over their garden and dropping bird poo on their washing.

im pretty sure the legal limit on fences ect is 6 ft,... they cannot put fences up on your side without your permission...hope u sort this with out a fall out !

I know with hedges i.e lleylandii in particular its 6ft but not sure about fences, bad admission from a fencing contractor lol

hello i do believe a back garden fence must only be 6 ft in height and a front fence must be no higher than 4ft ..hope this helps you out a little :)

Maximum height for any fence behind the building line is 2 metres high (6 foot 6 inches), and 1 metre high (3 foot 3 inches) in front of the building line, (which includes the boundary with the public footpath).
The building line is basically the line across the front brickwork of your house.
Check that there aren`t any restrictive covenants on the deeds of your property. There are on mine. Basically all the houses in my road were all designed with open plan front gardens, and no fences of any sort are allowed to be erected without planning permission. Any fences originally built with the property obviously can remain and replaced to the same spec.
Your neighbours are not allowed to build onto your property, so don`t worry about upsetting them as they are clearly not bothered about upsetting you.
My experience of this type of dispute is to stick up for your rights and deal with it directly. If you let them get away with this they`ll continue to walk all over you. show them you mean business, politely if at all possible but firmly.
You have the law on you side (as well as your neighbours fences).

Thanks for the help, I have made a choice now to use the fence to my advantage and intend groing a lovely climber up it. The other neighbours however are still very uoset about it and are taking legal action on the grounds that it inhibits their boiler outlet and is therefore dangerous.

if there are exposed nails protruding into your side then there is an health and safety issue, is it a shared fence? the right of light as i belive, is that you or should i say the building would have had the light for over 100 years potty i know whatever the first thing is to approach the people calmly and tell them your objections if they wont listen or just dismiss you out of hand they they give you no option then to find out your legal position and then you must decide good luck

All fencing and walls must be no more than 2 meters in height.Unless more than 1 meter from a highway.Hedges confers etc can be allowed to grow to stupendous heights.
But nowadays local councils tend to insist that that hedges conifers etc do not exceed 4 meters in height.
You may need to check ya boundries,but the frame(inside of fence)should be on their side(you get the good side).
With regards to birds flying over their land explain that they do not belong to you and that they should contact the owners of the birds.
I suspect that you are dealing with people with limited grey matter.
